Terms and Conditions
Advertising
All client content contained in this web site under Escorts, Massage, Strippers,
Alternative and Males are provided to ProviderPost.com by independent
contractors for the purpose of paid advertisements and are the sole
responsibility of said clients. ProviderPost.com cannot be held responsible for
any claims arising from the advertisements.
This page outlines the contract between Client and ProviderPost.com. By
submitting an ad(s), the Client agrees to the following terms and conditions,
and affirms their understanding of said terms and conditions set forth herein.
1. Client herby discloses that they:
(a) are 18 years of age or older.
(b) have read, understood and agrees to be bound by the terms of this agreement.
(c) are authorized to grant the rights and permissions stated below.
2. Client hereby warrants and represents that all images, words and/or other matter they provide for use in their advertisement(s) on this site are that of the Client and no other. Client irrevocably grants ProviderPost.com the right to use said content in connection with Client's ad(s) on the website. Providerpost.com prohibits posting of images that are pornographic or which depict a human being engaged in actual sexual conduct including but not limited to (i) sexual intercourse, including genital-genital, oral-genital, anal-genital, or oral-anal, whether between persons of the same or opposite sex, or (ii) bestiality, or (iii) masturbation, or (iv) sadistic or masochistic abuse, or (v) lascivious exhibition of the genitals or pubic area of any person. In accordance with title 18 U.S.C. 2257, every "Producer" of certain "sexually explicit content" must keep records proving the people portrayed in photos or videos are over the age of 18. Producers of sexually explicit content who don't comply face federal prison terms of up to 5 years for the first offense and up to 10 years for the second offense. Providerpost.com prohibits the posting of sexually explicit content. PLEASE DO NOT ABUSE OUR SITE!!!
3. Client acknowledges and agrees that all copyright, trademarks and other
intellectual property in the website are owned and controlled exclusively by
ProviderPost.com and may be freely assigned, sublicensed or conveyed at its
discretion. Client acknowledges and agrees that ProviderPost.com may prosecute
any acts of infringement.
4. Client acknowledges and agrees to the following:
(a) ProviderPost.com does not engage in or provide advertising for any illegal
activities including, but not limited to, prostitution.
(b) ProviderPost.com reserves the right to decline or remove Clients ad(s), or
any portion thereof, from the website if Client's ad(s) is in violation of the
guidelines or is deemed inappropriate.
(c) ProviderPost.com may change its advertising rates and policies at any time.
(d) ProviderPost.com makes no guarantee as to the placement of Client's ad(s) in
any particular order or location on the website. Any failure by ProviderPost.com
to post Client's ad(s) to the website will not be deemed a breach of this
agreement. Errors in the content of Clients advertisements will be corrected by
ProviderPost.com as soon as possible, but shall not be perceived as a breach of
this agreement.
5. Resolution of disputes related to this contract shall be settled through
informal mediation and binding arbitration. Either party shall give notice to
the other of the existence of a dispute and the desire to commence resolution
proceedings. A third party arbitrator mutually agreed upon in writing by both
parties within thirty (30) days of such arbitration request will conduct
arbitration. Judgment upon the award rendered by the arbitrator shall be final
and cannot be appealed, and may be entered in any court having jurisdiction
thereof. Any award by an arbitrator will be in writing, signed by the
arbitrator, and will be binding upon the parties. Agreements reached by the
parties through mediation shall be in writing, signed by the parties, and shall
be binding upon the parties. All parties are giving up their rights to have
their disputes tried by a judge or a jury in federal or state courts.
6. Providerpost.com will not be held liable or responsible for any communication via email. You understand that all information, data, text, photographs, graphics, video, messages or other materials ("Content"), whether publicly posted,privately transmitted or link from Providerpost.com, are the sole responsibility of the person from whom such Content originated. Specifically, this means that YOU, and not Providerpost.com, are entirely responsible for all Content that you, post, email, transmit or otherwise make available via Providerpost.com. Providerpost.com does not control, and is not responsible for the Content posted and, as such, does not guarantee the accuracy, integrity or quality of such Content. You understand that by using Providerpost.com services, you may be exposed to Content that is offensive, indecent, inaccurate, misleading, or objectionable. The Providerpost.com site and Content available through Providerpost.com may contain links to other websites, which are completely independent of Providerpost.com. Providerpost.com makes no representation or warranty as to the accuracy, completeness or authenticity of the information contained in any such site. Your linking to any other webites is at your own risk. 7. Client has read, understood and agrees to comply with the above-mentioned
guidelines for placing ads on the website.
